(WMC-TV) - The Tennessee State Board of Judicial Conduct filed formal charges against Kay Spalding Robilio, Circuit Judge of the 30th Judicial District at Shelby County, for alleged misconduct in a domestic relations case.
According to the court's six page complaint filed May 14, Robilio independently investigated facts regarding a post-divorce child custody case.
In February 2012, Robilio allegedly undertook an independent investigation of the conditions present at the residence of the father by making a personal visit to the home.
In the complaint, chief disciplinary counsel Tim Discenza reports she inspected the home of the father. Then she later utilized her personal observations in making rulings and referring to matters concerning the parenting issues, according to the complaint.
"A judge shall not initiate, permit ... or consider other communications made to the judge outside of the presence of the parties concerning a pending or impeding proceeding," Discenza wrote in the complaint.
Robilio is required to respond to the charges in 30 days.
She was elected judge division five in 1990, and reelected in 2006.
