CLEVELAND, OH (WOIO) -

Our Scott Taylor discovered just after the FBI raid in April attorneys for National Trucking in Arkansas approached Pilot Flying J and Jimmy Haslam to discuss a settlement.

National Trucking attorney Don Barrett tells 19 Action News within two hours Jimmy Haslam responded and now a federal judge just signed a preliminary approval of the 15 page settlement that will be final in November.

More than a dozen trucking companies across the nation accused Pilot of pocketing money from rebate fuel sales that was owned to them.

The settlement calls for Pilot to pay back 100% of monies owned with 6% interest.

On Monday Scott Taylor discovered Pilot had already sent out refund checks to every customer they discovered was owned money after an internal audit.

An independent auditor will double check Pilot's math but Scott Taylor is told Pilot owes less than 300 companies out of 4500 a total somewhere between $24 and $40 million dollars.

Mike Roberts, one of the lead attorney's on the settlement for National Trucking tells 19 Action News "Jimmy Haslam did the right thing for his customers."

Attorney Don Barrett says, "I tip my hat to Jimmy Haslam. He stepped up to the plate and took responsibility to make things right."

The FBI is still investigating.  So far 5 pilot employees have pled guilty to federal charges.

Jimmy Haslam says, "This is an unfortunate time for our customers and our company but we remain committed to making things 100% right with our customers, to put systems in place to help ensure this does not happen again, and to re-earn our customers trust."
