Adrian residents get city fee returned

ADRIAN, MI (Toledo News Now) -

Some Adrian residents and businesses can expect to see a check from the city soon, when storm water utility fees are returned.

It was an annual fee that averaged about $20 per household. So far, almost 3,000 people have paid the utility fee this year, but they will soon be reimbursed after litigation in Jackson, MI.

Jackson had a similar storm water utility fee ordinance.

"The Court of Appeals in Michigan that determined the fee was not valid, and if you're going to charge a city-wide fee like that, it needs to go as a vote to the people," said Adrian City Administrator Dane Nelson.

Nelson says since they modified their ordinance to be more like Jackson's last year, they won't be keeping the money.

"We should do the right thing and follow that court's decision and begin the refund process," he said.

The city is aiming to get the refund checks out within the next six weeks. Street funds will be used in the meantime for storm water projects.
