Teen involved in attack on gay man not charged with hate crime

CLEVELAND, OH (WOIO) -

19 Action News uncovered a couple of bombshells in the case of a teen busted for an attack on a gay man.

Perhaps most startling: The possible hate crime charge in this case is ''not" in Ohio laws. We also found investigators believe he's part of a notorious west side gang.

We reviewed the teen's record and he's facing a robbery charge.

The Attorney General's Office tells us, "Ohio does not have a specific hate crime law that addresses homosexuality. The closest thing is the charge that applies to...crimes...due to...race ,color, religion, or national origin."

First district investigators knew about this teen and have dealt with him before.

They believe he's part of the Madison Madhouse gang. A west side gang police have battled for years, a gang that's made headlines for guns and drugs.

Also, the 16-year-old's record shows other cases including drug trafficking, menacing, burglary, disorderly conduct, and even a curfew violation at 9 years old. A woman at his home told us to get lost.

The victim in that attack, Jared Fox, tell us he hopes this leads to a new hate crime law in Ohio. 

Police still hope to make other arrests. The teen is now being held in a juvenile lock up. And we found he's never done time behind bars for any of his crimes.
