ADRIAN, MI (Toledo News Now) -

The fight over money from oil in Adrian is now heading to court. Former mayor and now mayoral candidate James Berryman has filed a complaint against the City of Adrian.

Berryman says the city violated the Open Meeting Act when they set up a trust fund for oil money. According to the complaint, he says the trust fund will cause harm to the city by not allowing commissioners of the administration to access money from the fund in case of a financial emergency.

Berryman is asking for a public hearing on the case, and wants the court to stop any more money from going into the trust fund until the hearing occurs.

The city's attorney did not want to comment on the accusations at this time, but says she will ask commission members to hire a special council to handle this case so there is no conflict of interest.

A pretrial conference has been scheduled for Jan. 13.
