MEMPHIS, TN -

(WMC-TV) - Charges against an independent contractor for FedEx Ground accused of killing a man repairing his tractor-trailer were dismissed in criminal court, according to a Shelby County District Attorney news release received Thursday.

Investigators initially charged Angelo Fields, 30, of Fort Worth, Texas with reckless homicide in the death of Hong Dao.

Fields, Dao and another man were making repairs on a trailer at a Memphis FedEx facility on 555 Compress Drive before it could be taken on the road.

After repairs were made to a brake hose, Fields got behind the wheel of the cab and began pulling forward; Dao was still repairing a flat tire on the trailer's rear passenger-side.

According to the news release, Dao was crushed by the wheels supporting the tandem trailers.

Despite Fields was indicted on criminal charges, assistant district attorney Greg Gilbert said further review of the case indicated that Fields bore no criminal responsibility in the case.

FedEx released the following statement before the charges were dropped:

We continue to cooperate fully with the authorities in their investigation of this tragic accident and our thoughts go out to Mr. Dao's family. Mr. Fields is no longer providing service for FedEx Ground. We are committed to safety at FedEx Ground and to ensuring that incidents like this do not occur in the future.

Gilbert said the case was a matter for the civil courts.
