A burning cross, a Smith county man beaten and shot by a family member, and in critical condition. We are told this is much more than a family feud, and outraged family members are calling it a "hate crime."
One of five men accused of shooting
and killing a Toledo gym owner in a robbery gone wrong went on trial Tuesday.
Deitrekk Boone is charged with murder
in the case.
Boone's day in court was a long time coming. Boone was on the run for
more than a year after police say he and four others tried to rob Joe Lengel
outside his south Toledo gym early on the morning of November 19, 2012. Lengel
was shot and killed in the course of the robbery, according to Toledo Police.
Boone was finally arrested outside a
Houston Golden Corral in December and brought back to Toledo to face murder
Boone has chosen a bench trial,
meaning a judge will decide his fate rather than a jury of his peers.
Matthew Managhan took a plea deal in the
case. Police say Managhan colluded with Boone to commit the robbery, and was present
when Lengel was shot. Managhan took a plea deal and will serve 15 years for his
role in the crime.
On Tuesday, Managhan told the court
that Lengel was not the intended target of the robbery. In fact, Managhan said,
the group planned to rob the owner of a nearby auto body shop. Managhan said
that person was dealing drugs at the time.
The judge threatened to hold Boone's defense attorney in contempt when
he made a gesture after having an objection overruled.
The trial will continue Wednesday.
Toledo News Now will have a crew in the courtroom for the duration
of this trial. Stay with us for the very latest.
